my manager decided that he is going to RIF me in October. I just filed for my AOS and EAD last week. So i would assume my receipt date would be some time in July.
I already have my I-140 approved with PD of Mar 2004
Please suggest what do I need to do ?. Since July to October is like 3 -months, I can get an EAD ( atleast Interim ).
So can I work on this EAD ?. What are the consequences ?. Should I re-start the whole process of Labor / I-140 / I-485 ? with the priority date of the I - 485 ?.
I am sooo fed up with this whole process already. But I don't want to leave this now. I will get the Green Card, and then take citizenship before I leave this country

My labour was filed for a software engineer position (java, udb, etc) 3 years ago. Over that time, my role has changed to a project manager. Infact I don't do any coding anymore. If I invoke AC21 after 180 days, can I switch to a Project Manager position?

I have an approved I140 and a PD of Apr 08. I am planning to change company .
Some where in May I heard the news that end of this year USCIS is going to halt concurrent filing of I-140 and I485 and introduce an extra step called Pre-App for I485 and which can only be done after I140 approval.
1) what are the chances that this would happen?
2) What will happen if one switches company after 180 days of PreApp of 485.
can he/she invoke Ac21 ?
3) will Pre-App makes one eligible for EAD/Parole ?

Thanks. Yes it is within driving distance, just the city is different.
I was tensed because I didn't know the right answer.
With all the H1 issues going on nowadays because of location, I wanted to confirm.
Say when I file my H1 extension, then the employer address is the going to be the new one, in the LCA.
So was concerned if it will raise any red flags.
What do you all think?

After many, many years of wait ( to be exact totally 8 ) I was about to pack my belongings and move on with my life but in other place.
For certain reasons, which I will not discuss there I could not return to my home country.
Looking back and analyzing decisions made by the HR and the lawyers that the company hired to handle my case I feel something very uncomfortable. My advice to those who are at the very beginning of the immigration path is "Never under any circumstances trust the immigration lawyer that was hired or recommended by your employer. Remember your employer's interests are exactly opposite to yours."
Anyway yesterday I got that coveted �We sent you an approval notice..." e-mail.
Am I excited? Not very. Certainly I would have been if this happened many years ago.
Another advice that I want to give is do not take this green card business to close to your heart. There are much more important things in this life.

Now that everything is current there would not be any need to per country quota. CORRECT?
Or since EB3 other is not current ("U") they cannot use AC21?
they have hinted retrogression in Sept for China, India, etc
Now if there is no per country quota, how can they retrogress EB for China, India, or any other country unless EB3 ROW is not current?

Buddy, you will need to send only one AR-11 but will need to call in your change of address for every application. One phone call will cover it all, but make sure you tell the Customer service person that you needed this to be changed for every case. Then you will get a confirmation letter at your mailing address for every case that you changed address on. That is what I had to do on my 485 and EAD application.
Also if you have any dependents over 21 (like spouse) then make sure your spouse is next to you or calls in separately to the Customer service. They will not allow you to speak for your spouse. You could do so for dependents under 21 though.
Here is the little official quote and the link:
If you are not a U.S. citizen and you have a case pending with USCIS you need to do both - call customer service and complete the Form AR-11. The AR-11 is used by non-U.S. citizens to meet the legal requirements of informing USCIS of any change of address. Presently, completing an AR-11 does not update your address on any pending case. Guys,
I was laid off from GC sponsoring employer and my previous attorneys may have withdrawn their G-28. Now I have started working for new employer but have not filed for AC21 yet. The new attorneys have sent G-28 forms (so they claim).
Now I really want to move from the place where I am living so that my commute is shorter for my new employer and am also having lot of problems in the apartment condo where I live. But my concerns for moving are:
1) Does submitting Ar-11 online , update the address for your pending I-485 also? I have read few stories on the net that people who moved during I-485 and also updated their address still got an RFE at old address OR even worst the USPS returned the notice saying the person does not live there anymore
2) I have also heard that sometimes the new G-28 forms does not reach your file and RFE/ NOID may goto old attorneys .
I have these two concerns because my previous employer is going to revoke my I-140 which is going to result in straight denial of I-485 and even if I need to file MTR I may not get the notice in the mail because I may have moved.
Is there anyone who has been in this situation or moved after filing I-485 and successfully updates their addresses so that they get any RFE/NOID/Denial at new address.

2) Looks like more applicaiton were filed at NSC than at TSC, Why?
3) Why even then TSC is late in issuing reciept?

If the petition is approved under Consular Processing then they need to leave the country. Other wise no. The reason for Consular Processing would be not maintaining the status continuously.
If you get I94 along with the approved H1B then you are fine. If not, you need to leave the country and get it stamped. Your other friends might have not got I94 along with their approved I94
