I am already working on EAD. I have got an employment offer from a big fortune 500 firm as a lead technical analyst. The offer is too good to miss. I am trying to understand in my job will be "same or similar" while my job responsibility was "programmer analyst" in labor certificate and i would get a job as lead architect. Following are some more details about may labor doc.
a) Though my job title is like programmer analyst, my SOC job code is given as 17-2071.00 which is "Electrical Engineer"
I was never an electrical engineer (not even by my education). I do not know why the original filer used such a SOC code. Now my new role (lead technical architect) will have a SOC code as 15-1031 as that is for computer architect.
Morever my new employer will not provide me a Ac21 portability matching my labor cert.
My role responsibility is following as per labor cert.

develop, create and modify general computer application software. Analysis user needs and design, develop software solutions. Design, develop, analyse and implement software and end user product. I don't get it - how can USCIS take a sample of 250 people out of the 65000 visas alotted and say that 21 % of them were fraud ( 13% totally and 8 % technically ) . Its like taking only the fraud cases out of thousands and then saying that there is 100% fraud. I bet the fraud cases are not as high as 20% that the author and USCIS say.
It is sad to see that although we H1b immigrants get paid more than the American people ( considering what the employer gets from the client ) and even then we have to hear that we are lowly paid. Speaking from my point of view I know I am paid far more than my american counterparts in the same job profile.

I don't know anyone in Chicago. But I think it does not matter. You can hire an attorney from other city/state as long as he/she is competent. We live close to chicago, but our immigration attorney is in Michigan.
We had a great experience with this attorney. She is thorough, clear, always accessible and prompt. And she does not charge a fortune either like others. She does not even charge extra for phone calls, emails, etc.
The office is Law Offices of Ingrid Brey P.C. in Grosse Point Park, MI. Just google it and call the office. Have them email their services/charges, etc.

If you had an approved H1B last, that means that you already are on H1B status as of Oct 01 2006. You can continue to work in US on H1B and get it transfered also. Only when you go out of country then you will have to get new H1B stamped. I also had L1 to H1 change.
The visa officer will surely ask you that "why did you change your status from L1 to H1" So be prepared with a good answer for that.

Hi,
My L1 and I-94 is valid till August 14th 2009 -- I want to know if I can travel India and come back before it is expired. Are there any restrictions on port of entry when visa is nearing to expire. I would not take chance if there is a porblem in international travel and if I have deportation issues at the point of entry then I am not willing to go. But I want to visit my parents as they are not doing well.
Also, I am thinking once I am back from India then I can apply for L1 visa extension -- is it a good idea to apply for extension after I come back or I can apply and go to India for vacation.
Please guide me as I am in a fix and I am not able to take any decession.

I had a G lens for a year or so then one day it just stopped working, my D lens I bought used and it's still working today. Also a D70 owner. The G was cheap and ended up kind of being a disposable in some ways, it was cheap enough so I'm not out that much.

My H1B extension is pending with the VSC. I want to upgrade my H1B extension to a premium process by paying 1000 USD.
Now, my question is - Can I do it myself thru efile or regular way using form I-907? Or should it be done only thru the employer or attorney?
I am asking this because my attorney is charging a ridiculous attorney fees of 250 USD on top of 1000 USD for upgrading my case to a premium!
Please help.

I have a valid H4 after receving the EAD now getting paid on 1099 (on an off), I am planning to visit India this year. My question is!
Can I come back on H4 (I have a valid stamp) or do I have to use my AP since I am using my EAD privileges for getting paid?
Will they know at the Point of Entry that I am using my EAD?

I would transfer to a visitor visa and then identify which university and course I want to join. Once I have all the things lined up I would hire a good attorney and file for a new F1.

i was on opt and my opt ended jan 24th 2009. i had applied to a masters program for spring 09. my old school ( where i did my bachelors) transfered my sevis information to my new school( where i was to start masters). however i decided to discontinue with my new school's masters program. i did not registered for classes. i told them that i would no longer want to pursue that particular masters anymore. i now want to join another institute for a short time. they require my sevis information in order to make an i20 for me. my new school( where i had applied for masters) says that they do not have an i20 for me since i cancelled my program. whichever institute i transfer to for future studies would require a copy of a current i20 from me for admissions.
now where does this situation leave me? am i out of status as of now? will i be able to transfer to any university/institute for my future studies?

My experiance.... My 6th year on H1 expired beg Dec 2007. I applied for H4 Mid November 07 and haven't received a response yet. My attorney said as long as you file H4 before your H1 expire you're in status.

Can the work experience without H1B be countable when you apply for I140 (EB2, BS + 5yrs ) ?
I kept my part time job about 3 yrs while I was working as a full timer at other companies. But the problem is I was getting paid but didn't file H1B as a part timer. I know that I should have filed for H1B but I just had a H1B as a full timer with my other company. If I can count my part time work experience ( 3yrs part time / 2 = 1.5 yrs as full time) along with my full time experience (3.7 yrs), It exceeds 5 yrs of related work experience that requires for EB2.

Hello, I am on the same boat... kinda...
I submitted the application with supporting doc paper base on June 2 and they receieved and signed the package on June 7 to NSC
Til today check was not cashed. I called the service center and the lady told me to wait til July 8 to call them again and they will look in to it... and she said since it's summer time NSC is backing up.... and it does take up to 30 days to get anything.
(However, I have been reading... ppl efile seem have better luck to get any movement... some ppl got the EAD card within 20 days!!!!!)
I read some ppl also did paper and after a month... they go for the efile... but I still did not hear if that would creat any problems...
I don't mind to waste the 340 if it can make my EAD processed....
I would rather have the card in my hand then check my checking account everyday to see if the check was cashed....
anyone did both paper and efile after one another and got approved????
