Check with your international students office. In our time, they needed to sign the I-20 before you/your wife can leave the country. I also think she needs a separate I-20 with a F2 endorsement. She should not just carry your I-20 with her name in it, then you are supposed travel with her. Again, these were the old rules and I am not an attorney and this is not a legal advise, just from my personal experience.

I have not heard any schedule for these bills. There was a hearing last week, but I couldn't find the outcome of the full hearing. May be someone from IV Core can tell us what is scheduled for the coming days.

Hi,
I have AOS and was recently laid off from my job. As I haven't found another job by the removal-from-payroll deadline, my H1B will expire. My question is, once I get my EAD, can I apply for a new H1B. The motivation is that I can bring a spouse over on a dependant visa only on H1B but not on AOS. How should I work this out?

My mother came for a 6 months visit on December 10th of 2010. But she left in April of 2011 (April 9th 2011), two months short of her 6 month's stay. Can she come again in August 2011 for a six month's stay, and stay till Feb 2012? Or will she have to return in 2 months? (return by October 2011)
My mother has 10 year multiple entry visa.
I heard that a visitor can stay only 6 months in a year, is it true?
If yes, is the calendar year counted from January to december?

When 140 is denied, then 485 is also denied. Appeal going to AAO is common thing. Will sit there forever. Its takes approximately 12-20 months to get a reply.
Mine is already crossed 12 months now.

I believe your sister can apply for you int he 4th Family based category.
Below is the family based catgory, you can find this in any visa bulletin too.
FAMILY-SPONSORED PREFERENCES
First: Unmarried Sons and Daughters of Citizens: 23,400 plus any numbers not required for fourth preference.
Second: Spouses and Children, and Unmarried Sons and Daughters of Permanent
Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, and any unused first preference numbers:
A. Spouses and Children: 77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;
B. Unmarried Sons and Daughters (21 years of age or older): 23% of the overall second preference limitation.

If you were a student on F1, and if you just got an OPT (Employment Authorization), you do not have to pay Social Security tax. Once you switch to H1, you have to pay the SS tax.

I got EAD cards at my new address, but no FP notice yet. Have I missed that or USCIS might not have sent it yet?

Call USCIS and find out. As per my knowledge, USCIS does not update it online once they send out the FP notice.

Hi,
I am planning to file EB2 and port my EB3-I140 PD. My current position is System Analyst with EB3 job requirement. I can get a promotion but that doesnt qualify for EB2 job requirement. So I am planning to move to a different position, Research Associate which qualifies for EB2(it requires masters degree) with the same employer. Can I file EB2 with this position and port my EB3-I140 PD? Advice pls.

Yes you can apply for EAD and AP separetly anytime
The only catch I found out recently is that when you use AP to travel back to US, this may invalidate the H visa and you will need EAD.
I am still not clear of this issue. I applied for EAD few months ago and found out this may be an issue , so have applied for AP (By e-filing) now

I have question for you. How many APs we have to show at POE? One of my friends, he came from Canada, at POE they took 2 APs. They stamped on both of them. One they took and one they gave back to him with stamp.
As of I know. We need to give 1 AP at POE. Is this true?

Hi,
My attorney had filed our 485 at Nebraska SC on July 30th. She didnt file EAD & AP.
On August 10th I myself filed EAD & AP at Nebraska SC. I got receipts for AP. For EAD, they have sent back our docs saying that 765 has been filed with improper fee (guy who picked the file is not aware of July VB fee valid till Aug 17th). So I have sent back the documents with a cover letter stating we come under July VB, after a week they sent back the packet again with same reason to file with proper fee of $340. I dont want to waste time and energy.. so this time I have sent $340 and after a week on Oct1 we got receipts for EAD.
Mean while I called USCIS to check the status of my 485 and luckily got the receipts numbers from them. The file has been transferred to Texas.
My questions are:
1.The received date on the EAD receipt is stated as September 27th. But the very 1st time we filed was August 10th. So would they treat our file as that filed on August 10th or Sep 27th???
2.My EAD & AP are at Nebraska and 485 is at Texas..would that cause any delays..concerns?
Anyone been thru such experience. Please throw some light.
